FLIS® Fashion Law Encounters: Trademark vs. Domain Name.
The domain name has become one of the distinctive signs of companies on the Internet, popularizing the expression: ¨if you are not on the Internet, you do not exist¨ But, in some cases this name adjoins registered trademarks of third parties. What are the legal implications?

Currently, the ease of connection and location of people or companies provided by the Internet is not unrelated to the conflict that is generated when third parties register domain names that coincide with registered trademarks. Conflict that is intensified if both are used to identify the same products and services. This coincidence can harm the owner of a trademark, for this reason the Spanish Trademark Law as well as other legislations have adopted protection mechanisms to deal with this problem.
In this FLIS Fashion Law Meetings, we will analyze this conflict based on the article in the magazine FLIS Moda y Derecho al Día 5/2020 , developed by lawyers Cristiane Tages da Silva and Frederica Richter under the theme: "Conflict between domain name and fashion brand", where the issue is analyzed in light of Brazilian legislation and from FLIS we will make an analysis from the Spanish trademark law.
